Conflicto de competencia suscitado entre el Juzgado Veintiséis Penal del Circuito de Medellín y la Sala Primera de Oralidad del Tribunal Administrativo de Antioquia.
Tras precisar que la controversia planteada se basó en la aplicación de las reglas de reparto contenidas en el Decreto 1382 de 2000, relacionadas con la naturaleza de la entidad demandada, reitera la Corte que este hecho no tiene incidencia laguna para efectos de la competencia.
Se decide el asunto con la remisión del expediente al juzgado mencionado, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el auto del 26 de julio de 2016 proferido por el Juzgado Veintiseis Penal del Circuito de Medellin, dentro del expediente ICC-2990.
- SEGUNDO. DECIDIR el aparente conflicto de competencias, en el sentido de ordenar la REMISION del expediente ICC-2990 al Juzgado Veintiseis Penal del Circuito de Medellin, para que, de manera inmediata, tramite y adopte la decision de fondo a que haya lugar, dentro de la accion de tutela presentada por la senora Luz Marina Holguin Uribe contra el Juzgado Cuarenta y Dos de Instruccion Penal Militar.
- TERCERO. ORDENAR que, por Secretaria General, se comunique la decision adoptada en esta providencia a las partes y a la Sala Primera de Oralidad del Tribunal Administrativo de Antioquia.
