El recurso fue interpuesto por el Asesor Jurídico de la Comisión Nacional del Servicio Civil, bajo el argumento del desconocimiento del precedente de la Sala Plena o de la jurisprudencia en vigor de las Salas de Revisión y, la omisión arbitraria de análisis de aspectos de relevancia constitucional.
Por no presentar cargos que demostraran la existencia de una vulneración del debido proceso de manera ostensible, probada, significativa y trascendental, la Sala Plena de la Corporación decidió RECHAZAR la nulidad invocada.
