La controversia se generó en torno a las diferentes interpretaciones que hicieron los despachos judiciales involucrados del factor territorial.
Teniendo en cuenta que ambos juzgados son competentes para tramitar la acción de tutela, la Corte respeta la elección que a prevención hizo el actor y dispone enviar el expediente al Juzgado Primero Penal Municipal Con Función de Control de Garantías de Tunja, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
