El peticionario fundamentó el recurso en el hecho de que las entidades encargadas del cumplimiento del fallo de la referencia presentaron, a su juicio, una solución no sólo extemporánea sino amañada, en la que interpretaron y ejecutaron las órdenes dadas de manera tergiversada.
La Sala de ABSTUVO de tramitar el incidente y dispuso remitir el escrito al Juzgado Promiscuo Municipal de San Antonio (Tolima), para que resuelva lo pertinente.

- PRIMERO. ABSTENERSE de tramitar el incidente de desacato promovido por el ciudadano Ricaurter Molano Villanueva contra el Alcalde Municipal de San Antonio -Tolima-, el Inspector de Policía y el Personero Municipal de la misma entidad territorial, en el marco del cumplimiento de la Sentencia T-243 de 2019, de conformidad con la parte motiva de la presente providencia.
- SEGUNDO. REMITIR al Juzgado Promiscuo Municipal de San Antonio, Tolima, la solicitud de apertura de incidente de desacato promovido por el ciudadano Ricaurter Molano Villanueva contra el Alcalde Municipal, el Inspector de Policía y el Personero del municipio de San Antonio -Tolima-, para que resuelva lo pertinente, en los términos de las consideraciones de la presente providencia.
- TERCERO. Por Secretaría General de la Corte Constitucional, COMUNÍQUESE la presente decisión al peticionario16.
