El Procurador General de la Nación manifestó su impedimento para conceptuar en el proceso de la referencia, al considerar que tiene un interés directo en el mismo respecto de algunos apartes del artículo 86 de la Ley 1801 de 2016.
La Corte considera que el impedimento alegado no resulta justificado, en tanto la norma examinada es de carácter general y por ende, presenta supuestos de hecho generales e impersonales respecto de los cuales no es posible, en el caso concreto, identificar que pueda existir un interés personal, patrimonial o moral del Jefe del Ministerio Público, que pueda afectar su desinterés u objetividad para el ejercicio de sus competencias constitucionales en la materia. consecuentemente con lo anterior, la Sala Plena de la Corporación decide declarar INFUNDADO el impedimento formulado.
