Tras advertir la Corte que la controversia entre los despachos judiciales se originó únicamente en la aplicación de las reglas de reparto contenidas en el Decreto 1382 de 2000, lo cual no genera ni siquiera un conflicto real de competencia, resolvió el asunto con la remisión del expediente a la autoridad a quien primero fue repartido, esto es, al Tribunal Superior de Valledupar, para que de manera inmediata lo tramite y adopte la decisión de fondo a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el auto del 26 de abril de 2016 proferido por el Tribunal Superior del Distrito Judicial de Valledupar -Sala Civil, Familia y Laboral- , dentro del expediente ICC-2460.
- SEGUNDO. ORDENAR la remisión del expediente ICC-2460 al Tribunal Superior del Distrito Judicial de Valledupar -Sala Civil, Familia, para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar, dentro de la acción de tutela presentada por el señor Alveiro Guerrero Bayona actuando en representación de la Empresa Cooperativa de Trasportadores de la Sierra Nevada "CooTransNevada" contra la Superintendencia de Puertos y Transporte.
- TERCERO. ORDENAR que, por Secretaría General, se comunique la decisión adoptada a las partes y al Juzgado
- Segundo. Administrativo Oral del Circuito Judicial de Valledupar.
