Conflicto de competencia suscitado entre el Juzgado 14 Administrativo Oral del Circuito de Bogotá y el Juzgado Promiscuo del Circuito de El Bagre (Antioquia).
La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos despachos presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos fundamentales alegada por la parte accionante.
La Corte dirime el conflicto ordenando enviar el expediente al Juzgado Promiscuo del Circuito de El Bagre, para que de forma inmediata inicie el trámite de amparo respectivo y profiera la decisión a la que haya lugar.

- Primero. DEJAR SIN EFECTOS el auto del 2 de febrero de 2022 proferido por el Juzgado Promiscuo del Circuito de El Bagre, Antioquia dentro de la acción de tutela formulada por el señor Juan Fernando Gutiérrez Berrocal contra la Nación -Ministerio de Defensa Nacional, Dirección de Sanidad, y el Comandante del Batallón Especial Energético Vial N°. 5.
- Segundo. REMITIR el expediente ICC-4144 al Juzgado Promiscuo del Circuito de El Bagre, Antioquia, para que, de forma inmediata inicie el trámite de amparo respectivo y profiera la decisión que corresponda en la acción de tutela promovida por el señor Juan Fernando Gutiérrez Berrocal.
- Tercero. Por la Secretaría General de esta Corporación, COMUNICAR la presente decisión a la parte actora y al Juzgado 14 Administrativo Oral del Circuito de Bogotá.
