Impedimento manifestado por el magistrado José Fernando Reyes Cuartas.
El doctor Reyes adujo que estaba impedido para participar en la sustanciación, discusión y votación del expediente de la referencia porque estar incurso en la casual prevista en el numeral 1º del artículo 56 del Código de Procedimiento Penal.
Ello, porque se desempeñó como magistrado de la Sala Penal del Tribunal Superior del Distrito Judicial de Manizales durante el período 2004-2017 y obtuvo judicialmente el mismo reconocimiento prestacional cuyo pago se persigue en el proceso ejecutivo cuestionado en la acción de tutela bajo estudio.
Los otros dos integrantes de la Sala de Revisión consideraron que en el presente caso no hay un interés directo, personal y actual por parte del doctor Reyes Cuartas que justificara apartarlo del conocimiento del caso de la referencia y, en consecuencia, decidieron declarar INFUNDADO el impedimento que se analizó en esta oportunidad.
