La Sala Plena establece que la acusación formulada en la demanda de la referencia, corresponde al mismo cargo y a la misma norma que fue objeto de pronunciamiento por parte de la Corte Constitucional en su sentencia C-410/94.
No se accede a un nuevo examen de constitucionalidad por cuanto el fallo hizo tránsito a cosa juzgada.
Se resuelve confirmar el auto objeto de súplica.
