Se dejaron sin efectos los autos proferidos por el Juzgado Décimo Penal del Circuito con Funciones de Conocimiento de Medellín, dentro de la tutela formulada por el ciudadano de la referencia en contra de la Inspección de Tránsito y Transporte Municipal de La Dorada -Caldas-.
La Corte advirtió que el expediente fue repartido al mencionado juzgado pero éste desatendió la regla jurisprudencial prevista en el numeral 1 del Art. 36 de la Ley 906 de 2004, al abstenerse de impartirle el trámite respectivo al recurso interpuesto por el accionante, a pesar de que, dada su categoría y especialidad jurisdiccional, era el llamado a pronunciarse sobre la impugnación a que se alude.
En consecuencia, se remite el expediente al despacho judicial citado para que, de manera inmediata, tramite y decida la impugnación presentada.

- Décimo. Penal del Circuito con Funciones de Conocimiento de Medellín, dentro de la acción de tutela formulada por el ciudadano Jheremi Chaves Villota en contra de la Inspección de Tránsito y Transporte Municipal de La Dorada -Caldas-.
- Segundo. REMITIR el expediente ICC-3320 al Juzgado
- Décimo. Penal del Circuito con Funciones de Conocimiento de Medellín, para que, de manera inmediata, tramite y decida la impugnación presentada.
- Tercero. Por la Secretaría General de la Corporación, COMUNICAR a las partes y a la Sala de Decisión Constitucional del Tribunal Superior del Distrito Judicial de Medellín la decisión adoptada en esta providencia.
