La controversia entre los despachos judiciales se suscitó por las diferentes interpretaciones que hicieron los despachos involucrados del factor territorial.
Teniendo en cuenta que ambos juzgados son competentes para conocer la acción de tutela y que el accionante, de acuerdo con la competencia a prevención, escogió a las autoridades de Cúcuta para presentar la solicitud de amparo, se dispone remitir el expediente al Juzgado Séptimo Civil Municipal de Oralidad de esta ciudad, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
