La directora ejecutiva de la Federación Nacional de Departamentos pidió a la Corporación ampliar o diferir nuevamente los efectos del fallo de la referencia hasta la cuarta legislatura (julio 2021-junio 2022), a fin de que el Congreso, dentro de la libertad de configuración legislativa, expida la norma que determine o fije los criterios concretos y específicos para determinar la base gravable de la sobretasa a la gasolina y del ACPM.
La Sala Plena constató que la pretensión formulada fue presentada de manera extemporánea y por ello decidió RECHAZARLA
