Recusación presentada por el Ministerio de Salud y Protección Social en contra del magistrado José Fernando Reyes Cuartas.

Al analizar el asunto la Sala concluyó que era improcedente.

Frente al particular, recordó que la ley y la jurisprudencia han establecido que la recusación no procede en los juicios de tutela, ni en sus instancias, ni en el trámite especial de revisión que se surta.

Así mismo, consideró que el solicitante tampoco explicó las razones que motivarían una aplicación diferente al caso concreto y que, además, construyó la petición a partir de una normativa ajena al proceso de tutela, esto es, el artículo 141, numeral 12, del Código General del Proceso y el Decreto Ley 2067 de 1991.

Con base en lo anterior se RECHAZÓ.

  2. Segundo. Contra esta decisión no procede ningún recurso.
