Conflicto de competencia suscitado entre el Juzgado Segundo Administrativo de Pasto y el Juzgado Once Civil del Circuito de Bogotá.
Encontró la Corte que en este caso sólo se presentó un conflicto aparente en la medida en que la primera autoridad, invocando las reglas previstas en el Decreto 1834 de 2015, remitió las diligencias al otro despacho judicial precitado.
En su criterio, había identidad de causa, objeto y sujeto pasivo respeto de otra solicitud de amparo que se tramitaba en dicho despacho.
Teniendo en cuenta que no se señaló con rigor demostrativo y coherente el cumplimiento de los presupuestos que integran la triple identidad, la Corte dispuso enviar el expediente al Juzgado Segundo Administrativo de Pasto para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.
