Con el presente auto se resuelve varias recusaciones formuladas en contra de los magistrados Alejandro Linares Cantillo y Alberto Rojas Ríos para que se separen del conocimiento del incidente de nulidad contra la Sentencia SU.587/17.
La Sala Plena de la Corporación rechaza por IMPROCEDENTES las solicitudes de recusación presentadas.
Se precisa que, en el trámite de tutela no es procedente la recusación por tratarse de un trámite que debe ser célere y sumario.
El incidente de nulidad en contra de una sentencia de tutela hace parte del trámite de tutela y le son aplicables sus mismas normas.
El incidente de nulidad no es un mecanismo para promover recusaciones después de que se ha emitido la sentencia y, los magistrados cuestionados no manifestaron estar incursos en ninguna de las causales de impedimento al momento de fallar la sentencia de unificación referida.
