Conflicto de competencia entre el Juzgado Penal del Circuito de Ramiriqui, el cual considera que no es competente toda vez que la acción se dirige contra una autoridad de orden municipal, y el Juzgado Primero Promiscuo Municipal el cual declaró su incompetencia invocando que el juez ante el cual se presentó la acción debió conocer de la misma.
La Sala encuentra que la entidad accionada es de orden municipal y por lo tanto el amparo debe ser tramitado frente a los Jueces Municipales por lo tanto se decide remitir el expediente a el Juzgado Primero Promiscuo Municipal de Ramiriqui.
