Solicitud de Nulidad de la Sentencia SU.424/12.

A través de apoderado judicial se solicita a la Corte Constitucional declarar la nulidad de la sentencia de la referencia, alegando vulneración al debido proceso al reducir el problema jurídico del reconocimiento a la pensión de jubilación a un problema de apreciación de pruebas e interpretación de normas jurídicas.

Se solicita además de la declaratoria de nulidad parcial del fallo, proferir uno nuevo que guarde concordancia con la sentencia de casación del 17 de octubre de 2008 y el alcance de la impugnación formulada en la precitada demanda de casación.

La Sala Plena decide RECHAZAR por extemporánea la solicitud de nulidad impetrada.
