En el presente caso la Corte Suprema de Justicia decidió decretar la nulidad del fallo emitido por el Tribunal Superior de Cali y remitir el expediente al Juzgado Veintiuno Penal del Circuito de Cali, sin tener en cuenta que mediante auto 034 de 2010 ya se resolvió el conflicto de competencia y se ordenó al Tribunal emitir el fallo de primera instancia, por lo tanto se decide devolver el expediente a la Sala de Casación Penal de la Corte Suprema de Justicia para que proceda a resolver la segunda instancia dentro de la acción de tutela.

- PRIMERO. DEJAR SIN EFECTOS el auto proferido por la Sala de Casación Penal de la Corte Suprema de Justicia, de fecha 28 de junio de 2010 mediante el cual declaró la nulidad de lo actuado.
- SEGUNDO. REMITIR el expediente de la referencia a la Sala de Casación Penal de la Corte Suprema de Justicia para que continúe el trámite de la segunda instancia y profiera decisión de fondo respecto del amparo solicitado.
- TERCERO. REMITIR copia del auto 034 del 27 de febrero de 2010 a la Sala de Casación Penal de la Corte Suprema de Justicia.
- CUARTO. Por Secretaría General, COMUNICAR al Juzgado Veintiuno Penal del Circuito de Cali la decisión adoptada en esta providencia, con el fin de que tenga conocimiento sobre lo aquí resuelto.
