Solicitud de aclaración de la Sentencia T-314/17.
La petición fue formulada por la representante legal y apoderada para asuntos judiciales de la Fundación Hospital de la Misericordia (HOMI).
De manera específica se pidió aclarar los resolutivos cuarto y quinto del precitado fallo.
La memorialista dujo que frente a la orden impartida por la Corporación existe un vacío, ya que no indica quién asumiría la suma de dinero exonerada, en tanto la EPS Cafesalud ya no existe.
Luego de reiterar jurisprudencia relacionada con la procedencia excepcional de las solicitudes de aclaración de las providencias proferidas por la Corte Constitucional, constató la Sala que se incumplió con el requisito de oportunidad.
Esto, porque se presentó por fuera del término de ejecutoria.
Con base en lo anterior se RECHAZÓ, por extemporánea, la aclaración rogada.
