Conflicto de competencia suscitado entre el Juzgado Segundo Penal Municipal de Soledad (Atlántico) y el Juzgado Cuarto Civil Municipal de Oralidad de Barranquilla, en torno al trámite de la acción de tutela de la referencia.
La Sala considera que la autoridad judicial que debe asumir el conocimiento de la solicitud de amparo presentada es el juzgado donde la accionante decidió presentarla “a prevención”, es decir, el juez del lugar donde ocurrió la vulneración alegada.
Se decide el asunto ordenando la remisión del expediente al Juzgado Segundo Penal Municipal de Soledad (Atlántico), para que asuma de manera inmediata y sin dilaciones el conocimiento de la acción de tutela deprecada.
