Se declaró la nulidad de todas las actuaciones surtidas en la presente tutela desde el auto admisorio de la misma proferido por el Juzgado 12 Penal del Circuito de Cali, toda vez que se incurrió en la omisión de notificación a la parte interesada y de entidades responsables.
En consecuencia, se ordenó al citado Juzgado reiniciar el proceso de su conocimiento, previa notificación a todas las partes interesadas y al Instituto de Seguros Sociales, así como a todas aquellas entidades que en su criterio deban responder.
Surtido dicho trámite, la acción de tutela seguirá el curso señalado en el Decreto 2591 de 1991.

- Primero. DECLARAR la nulidad de todas las actuaciones surtidas en la presente tutela desde el auto admisorio de la misma proferido el 26 de abril de 2002 por el Juzgado Doce Penal del Circuito de Cali.
- Segundo. ORDENAR al Juzgado Doce Penal del Circuito de Cali, que reinicie el proceso de su conocimiento, previa notificación a todas las partes interesadas y al Instituto de Seguros Sociales, así como a todas aquellas entidades que en su criterio deban responder. Surtido dicho trámite, la acción de tutela seguirá el trámite señalado en el decreto 2591 de 1991.
- Tercero. Por Secretaría, REMITIR el expediente de la referencia al Juzgado Doce Penal de Circuito de Cali, a fin de que se surta el trámite indicado en el numeral anterior.
