Se remitió el expediente a la Sala Penal del Tribunal Superior de Medellín para que defina cuál de los dos juzgados penales del Circuito es competente para conocer de la acción de tutela incoada por el ciudadano de la referencia contra el Seguro Social, toda vez que cuando se presenta un conflicto entre juzgados de una misma categoría que pertenecen al mismo distrito judicial, tal como ocurre en el asunto analizado, la competencia se determina según las normas de procedimiento que rigen la materia y, por tanto, corresponde dirimir el conflicto al superior jerárquico común.
