Se declaró la nulidad de todo lo actuado en la acciones de tutela promovidas por los ciudadanos de la referencia a partir del auto proferido por la Sala de Casación Penal de la Corte Suprema de Justicia; y, por otro accionante, a partir del auto proferido por el Tribunal Superior del Distrito Judicial de Cali, Sala de Decisión Penal.
En consecuencia, se ordenará a la Sala de Casación Penal de la Corte Suprema de Justicia, imprimir a estas tutelas el trámite que corresponda.
Lo anterior, porque se aplicó lo dispuesto en el Art. 1° del Decreto 1382 de 2000 que no resulta aplicable por ser contrario a la Carta Política.

(1) de marzo de 2001, proferido por la Sala de Casacion Penal de la Corte Suprema de Justicia; y, por Jairo de Jesus Montoya Agudelo, a partir del auto de dieciseis (16) de noviembre de 2000, proferido por el Tribunal Superior del Distrito Judicial de Cali, Sala de Decision Penal. En consecuencia, se ordenara a la Sala de Casacion Penal de la Corte Suprema de Justicia, imprimir a estas acciones de tutela, el tramite que corresponda.
- Segundo. REMITANSE los expedientes por Secretaria a la Corte Suprema de Justicia, Sala de Casacion Penal, para que, se le imprima a estas acciones de tutela el tramite que corresponda conforme a la ley.
