- Primero. DEJAR SIN EFECTO la actuacion posterior al auto del 11 de agosto de 2008 (inclusive) proferido por el Juzgado Doce Penal del Circuito de Cali dentro de la accion de tutela de la referencia.
- Segundo. ORDENAR al Juzgado Doce Penal del Circuito de Cali que, de forma inmediata, profiera la decision de primera instancia que corresponda en el asunto de la referencia, conforme a las previsiones del articulo 86 de la Constitucion Politica y del Decreto 2591 de 1991.
- Tercero. Por Secretaria General, comuniquese a los despachos judiciales en colision la decision adoptada en esta providencia.
