Conflicto de competencia suscitado entre el Juzgado 18 Laboral del Circuito de Bogotá y el Juzgado 1º Penal de Circuito de Montería.
Teniendo en cuenta que los dos despachos judiciales involucrados en la controversia son competentes para conocer el asunto, en razón a que uno es el lugar donde ocurre la supuesta violación del derecho y el otro donde se producen sus efectos, la Corte decide respetar la voluntad de la accionante y remitir el expediente al despacho judicial a quien inicialmente se repartió, esto es, al Juzgado 18 Laboral del Circuito de Bogotá, para que de manera inmediata lo tramite y adopte la decisión de fondo a que haya lugar.

- Primero. DEJAR SIN EFECTOS el auto del 5 de diciembre de 2016, proferido por el Juzgado 18 Laboral del Circuito de Bogotá, dentro de la acción de tutela formulada por Mercedes del Rosario Álvarez Jiménez contra la Secretaría de Salud del Departamento de Córdoba.
- Segundo. REMITIR el expediente ICC-2859, que contiene la acción de tutela presentada por la señora Mercedes del Rosario Álvarez Jiménez, al Juzgado 18 Laboral del Circuito de Bogotá para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
- Tercero. Por la Secretaría General de la Corporación, COMUNICAR a las partes y al Juzgado 1º Penal del Circuito de Montería, la decisión adoptada en esta providencia.
