Solicitud de nulidad. .
El memorialista solicitó anular la sentencia C-317/12y recusó a cinco de los magistrados que intervinieron en este fallo, por considerarlos incursos en una causal de impedimento para resolver el incidente.
La solicitud de nulidad se fundamentó en el desconocimiento del precedente en materia de consulta previa, en la violación del derecho a la confianza legítima al no segur la jurisprudencia aplicable y en la incongruencia del fallo.
La Corte consideró que ninguno de los cuestionamientos formulados cumplió con la carga de argumentación y que en virtud de ello la sentencia C-317/12no era susceptible de anulación.
