Mediante el presente auto la Sala de Revisión se abstiene de conocer el fondo del proceso de tutela de la referencia, acatando lo dispuesto por el Juzgado Primero Civil del Circuito de Cartago (Valle), respecto a la anulación del auto que remitió el expediente a la Corte Constitucional y la solicitud de devolución del proceso al Juzgado Promiscuo Municipal con Función de Control de Garantías de El Cairo (Valle), para que dicho despacho tramite la apelación impetrada por el actor.
Se ordena la devolución solicitada y se dispone que, una vez se surta la segunda instancia, se remita el expediente a la Corte Constitucional para su eventual revisión.

- PRIMERO. ABSTENERSE de efectuar la revisión de fondo de la sentencia proferida por el Juzgado Promiscuo Municipal con Función de Control de Garantías de El Cairo, Valle, por las consideraciones expuestas.
- SEGUNDO. REMITIR por Secretaría General de esta Corporación, el expediente T-3.550.885 al Juzgado Promiscuo Municipal con Función de Control de Garantías de El Cairo, Valle.
- TERCERO. Surtida la segunda instancia, remítase el presente expediente a la Corte Constitucional para su eventual revisión.
- CUARTO. Por medio de la Secretaría General de la Corte Constitucional, NOTIFÍQUESE esta providencia a las partes dentro del presente proceso de tutela.
