Se declaró la nulidad de todo lo actuado en la tutela interpuesta por el ciudadano de la referencia a través de apoderado, contra el Grupo Interno de Trabajo para la Gestión del Pasivo Social de Puertos de Colombia, del Ministerio del Trabajo y Seguridad Social, a partir del auto proferido por el Tribunal Administrativo del Valle del Cauca, que en vez de darle trámite, remitió el expediente a los Juzgados Civiles del Circuito (Reparto), para su conocimiento, dándole aplicación al Decreto 1382 de 2000 que es inconstitucional.
En consecuencia, se devolvió el expediente al citado Tribunal para que realice el trámite que corresponda conforme a la ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela interpuesta por Antonio Sanclemente Serna, a traves de apoderado, contra el Grupo Interno de Trabajo para la Gestion del Pasivo Social de Puertos de Colombia, del Ministerio del Trabajo y Seguridad Social, a partir del auto de 23 de noviembre de 2000, proferido por el Tribunal Administrativo del Valle del Cauca.
- Segundo. REMITASE el expediente por Secretaria al Tribunal Administrativo del Valle del Cauca, para que de manera inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la ley.
