Conflicto de competencia entre el Juzgado Tercero Oral de Familia de Barranquilla y la Sala Laboral del Tribunal Superior de la misma ciudad, en torno al trámite de la acción de tutela de la referencia.
La Corte advierte que no se presenta un conflicto negativo, en razón a que no se han puesto en debate los factores que determinan la competencia en materia de tutela previstos en la Carta Política y el Decreto 2591 de 1991, sino que se reduce a la aplicación de las reglas de reparto establecidas en el Decreto 1382 de 2000.
En tal sentido y en aplicación de la subregla establecida en el Auto 124/09, dirime la controversia ordenando la remisión del expediente al Juzgado Tercero Oral de Familia de Barranquilla, para que de manera inmediata tramite y decida de fondo el amparo presentado.
