Conflicto de competencia entre el Juzgado Primero Promiscuo Municipal de Cajicá (Cundinamarca) y el Juzgado Cuarto Promiscuo Municipal de Piedecuesta (Santander).
La Corte recuerda que el demandante puede presentar la acción de tutela ante los jueces, a prevención, para la protección de sus derechos constitucionales fundamentales, lo que le permite elegir entre el lugar donde ocurrió la vulneración, que no necesariamente coincide con el de su domicilio, y aquel en el cual tiene efecto la trasgresión de su derecho.
Teniendo en cuenta la decisión adoptada por el peticionario, la Sala decide remitir el expediente al Juzgado Cuarto Promiscuo Municipal de Piedecuesta (Santander), para que asuma de manera inmediata y sin dilaciones la solicitud de amparo formulada.

- Cuarto. Promiscuo Civil Municipal de Piedecuesta, mediante la cual resolvio que no era competente para conocer la accion de tutela presentada por el senor William Hernando Guerrero Gil.
- Segundo. REMITIR el expediente ICC 2851 al Juzgado
