Se declaró la nulidad de todo lo actuado en la tutela de la referencia a partir del auto proferido por el Juzgado Noveno Civil Municipal de Cartagena, toda vez que le dio aplicación al Decreto 1382 del 12 de julio de 2000 porque vulnera la Constitución Política.
En consecuencia, se ordenó remitir el expediente al citado Juzgado para que realice el trámite que corresponda conforme a la Ley.
