Se remitió el expediente al Juzgado Segundo Civil Municipal de Facatativá para que adelante la correspondiente actuación judicial.

Por lo anterior, esta Corte recordó que de acuerdo con el Art. 37 del Decreto 2591 de 1991, “son competentes para conocer de la acción de tutela, a prevención, los jueces o tribunales con jurisdicción en el lugar donde ocurriere la violación o la amenaza que motivaren la presentación de la solicitud”.

De esta manera, el sitio donde se materializa la violación o amenaza de cualquier derecho fundamental, es el factor que fija la competencia en razón del territorio de los jueces constitucionales, así las cosas, es éste el elemento que en primer lugar, debe tenerse en cuenta al analizar la competencia.

Siendo ello así, no le es dable al juez constitucional abstenerse de conocer de una acción de tutela con fundamento en que el domicilio del demandado se encuentra en territorio distinto al de su jurisdicción.
