Se declaró la nulidad de todo lo actuado en la tutela instaurada por el ciudadano de la referencia por intermedio de apoderado en contra del Consejo de Estado, Sala de lo Contencioso Administrativo, a partir del auto dictado por la Sala Penal del Tribunal Superior del Distrito Judicial de Bogotá.
En consecuencia, se ordenó remitir el expediente a la mencionada sala del Tribunal para que realice el trámite que corresponda conforme a la Constitución y la Ley.

- En merito de lo expuesto, la Sala Septima de Revision de la Corte Constitucional,
- RESUELVE
- Primero. Declarar la nulidad de todo lo actuado en la accion de tutela instaurada por Mario Bernardo Olea Vega, por intermedio de apoderado, presento accion de tutela en contra del Consejo de Estado, Sala de lo Contencioso Administrativo, a partir del auto del treinta (30) de octubre de 2000, dictado por la Sala Penal del Tribunal Superior del Distrito Judicial de Bogota. En consecuencia, por Secretaria General de la Corte remitase el expediente a la mencionada sala del Tribunal Superior del Distrito Judicial de Bogota, para que de manera inmediata se le imprima a la demanda de tutela el tramite que corresponda conforme a la Constitucion y la Ley.
