Incidente de recusación formulado a los Magistrados Luis Guillermo Guerrero Pérez y Alberto Rojas Ríos.
El ciudadano recusador le pidió a la Corporación retirar del conocimiento del asunto de la referencia a los precitados magistrados, por tener un interés especial en el mismo.
La Corte constató que el peticionario carece de legitimación en tanto no tiene la calidad de interviniente dentro del proceso, toda vez que no ejerció, dentro del término legal, el derecho a participar como impugnador o defensor del decreto legislativo sometido a control, de conformidad con lo dispuesto en los artículos 242-1 de la Constitución y 7 del Decreto 2067 de 1991.
Adicionalmente consideró la Sala, que la recusación no cumple con el rigor argumentativo requerido, pues no cumplió con el requisito material de la carga argumentativa.
Con base en las anteriores argumentaciones se RECHAZA la recusación, por falta de pertinencia
