Conflicto de jurisdicciones entre el Juzgado 1° Laboral del Circuito de Yopal y la Procuraduría Regional de Casanare.

Dicha controversia se originó respecto a la competencia para conocer una queja por presunto acoso laboral.

En esta oportunidad, la Sala Plena advierte que la controversia planteada corresponde a un caso similar al estudiado en el auto 345 de 2022.

Así, como quiera que una de las autoridades en disputa no forma parte de una jurisdicción, sino que es una autoridad administrativa que, además es un órgano de control (art. 117 C.P), no se presenta un conflicto de jurisdicciones.

En consecuencia, por carecer de competencia, la Corte se declaró inhibida para pronunciarse de fondo y remitió del expediente a la Procuraduría Regional de Casanare, por ser la autoridad a la que primero se remitió la queja, para que proceda según corresponda.
