Conflicto de competencia suscitado entre el Juzgado Segundo Civil del Circuito de Pereira y el Juzgado Tercero Civil del Circuito de Pasto.
A pesar de que ambos despachos judiciales son competentes para conocer la presente acción de tutela, considera la Corte que en virtud de la competencia “a prevención” del factor territorial, es el Juzgado Segundo Civil del Circuito de Pereira, como autoridad que recibió inicialmente el conocimiento del proceso, la autoridad que debe proceder con su trámite y resolución.
En consecuencia, se ordena remitir el expediente a este juzgado, para que proceda de conformidad.
