Recusación formulada en contra del magistrado José Fernando Reyes Cuartas para tramitar el incidente de nulidad elevado por el actor en contra del auto proferido el 16 de marzo de 2021, dentro del expediente PE-048.
Teniendo en cuenta que el actor incumplió su deber de exponer o justificar las razones por las cuales cuestiona la imparcialidad del Magistrado Reyes para tramitar el incidente de nulidad propuesto en contra del auto mencionado, la Sala Plena de la Corporación decidió NEGAR, por falta de pertinencia, la recusación presentada en este caso.

- PRIMERO. RECHAZAR por falta de pertinencia la recusacion presentada por el ciudadano HAROLD SUA MONTANA contra el Magistrado Jose Fernando Reyes Cuartas, para tramitar el incidente de nulidad propuesto por el actor en contra del auto del 16 de marzo de 2021, dentro del Expediente PE-048, Sentencia C-074 de 2021.
- SEGUNDO. Por Secretaria General de esta Corporacion, REMITIR al despacho del Magistrado JOSE FERNANDO REYES CUARTAS el escrito allegado a esta Corte16 por el ciudadano Harold Eduardo Sua Montana, para que decida sobre la procedencia de la solicitud de nulidad elevada por el solicitante, en contra del Auto proferido el 16 de marzo de 2021.
- TERCERO. Contra esta providencia no procede recurso alguno.
