Incidente de Desacato de la Sentencia T-360/10.

El memorialista considera que la sentencia de la referencia no ha sido cumplida por el accionado y en tal sentido presentó ante la Corporación un incidente de desacato, con el ánimo de que se establezca una sanción.

La Sala de Revisión reitera que le corresponde al Juzgado de primera instancia conocer del incidente de desacato y disponer las medidas a que eventualmente hubiere lugar.

En tal sentido, se decide NO ASUMIR la petición formulada y remitir la misma al Juzgado Sexto Civil Municipal de Neiva para que determine lo que estime pertinente.
