Solicitud de nulidad de la Sentencia T-333/21.

La Subsecretaria Jurídica de la Secretaría Distrital del Hábitat de Bogotá argumentó que la Sala de Revisión omitió arbitrariamente el análisis de un asunto de relevancia constitucional.

Sobre el particular expresó que la Corte realizó una valoración subjetiva del proceso administrativo sancionatorio sin darle relevancia técnica ni jurídica a los actos administrativos proferidos en el marco de dicho proceso.

Así mismo, adujo una incongruencia entre la parte motiva y resolutiva de la providencia y una falta de valoración de las funciones de la entidad distrital.

Luego de verificar el estudio de los requisitos formales del incidente propuesto, la Sala Plena concluyó que no se satisfizo el de oportunidad y, por ello, decidió RECHAZARLO.

RECHAZAR la solicitud de nulidad formulada por la señora Sandra Yaneth Tibamosca Villamarín, en calidad de Subsecretaria Jurídica de la Secretaría Distrital del Hábitat de Bogotá, en contra de la Sentencia T-333 de 2021, proferida por la Sala Segunda de Revisión de la Corte Constitucional.
  2. SEGUNDO. Contra esta providencia no procede recurso alguno.
