El incidente se fundamentó, entre otros cargos, en la violación al debido proceso por la indebida notificación, al no anexarse al fallo el salvamento parcial de voto anunciando.
Igualmente, en el desconocimiento del precedente y en la omisión probatoria.
Luego de estudiar detenidamente cada uno de los cargos formulados, la Corte decide NEGAR la nulidad impetrada.
