Se declaró la nulidad de todo lo actuado dentro de la tutela presentada por el Sindicato de la referencia, a partir del auto proferido por el Tribunal Superior del Distrito Judicial de Bogotá -Sala Penal- por cuanto quien debe conocer de la tutela es el juez escogido por el actor, cuya competencia se determina por el lugar donde hubiere ocurrido la violación o amenaza que motivó la acción.
En consecuencia, se remite el expediente a la Sala Penal del citado Tribunal para que realice el trámite que corresponda conforme a la ley.
Una vez cumplido lo anterior, regrese el expediente a la Corte Constitucional para su eventual revisión.

- Primero. Declarar la nulidad de todo lo actuado dentro de la acción de tutela presentada por el Sindicato Nacional de Trabajadores de ISAGEN S.A. E.S.P. -SINTRAISAGEN- contra la Sección Cuarta del Consejo de Estado, a partir del auto proferido por el Tribunal Superior del Distrito Judicial de Bogotá -Sala Penal- el 11 de diciembre de 2000 (folio 134 del expediente).
- Segundo. REMITASE el expediente de la referencia a la Sala Penal del Tribunal Superior del Distrito Judicial de Bogotá, para que, en forma inmediata, le imprima a esta acción de tutela el trámite que corresponda conforme a la ley.
- Tercero. Una vez cumplido lo anterior, regrese el expediente a la Corte Constitucional para su eventual revisión.
