Conflicto de competencia entre el Juzgado Catorce Civil Municipal de Oralidad de Medellín y el Juzgado Cuarto Promiscuo Municipal de Chinchiná (Caldas), en torno al trámite de la acción de tutela de la referencia.
Al encontrar que la controversia no estaba fundamentada en las reglas de reparto del Decreto 1382 de 2000, sino en el divergente entendimiento de los jueces sobre el alcance y aplicación del factor territorial, la Sala Plena se pronunció sobre el marco jurídico que regula la competencia de los jueces en materia de tutela y abordó el tema del factor territorial relacionado con el domicilio y el núcleo esencial de los derechos fundamentales.
Se dirime la controversia con la remisión del expediente al Juzgado Catorce Civil Municipal de Oralidad de Medellín, para que asuma de manera inmediata y sin dilaciones el conocimiento de la acción constitucional formulada.

- PRIMERO. DEJAR SIN EFECTOS el auto del 11 de Diciembre de 2015, mediante el cual, el Juzgado 14 Civil Municipal de Oralidad de Medellín rechazó la competencia para conocer la acción de tutela presentada por la ciudadana Ángela María Gaviria Londoño, en su calidad de representante legal judicial de la Administradora de Fondos de Pensiones y Cesantías Protección S.A.
- SEGUNDO. REMITIR el expediente de la referencia al Juzgado 14 Civil Municipal de Oralidad de Medellín para que asuma de manera inmediata y sin dilaciones el conocimiento de la acción de tutela de la referencia.
