Recusacion Formulada Contra El Procurador General De La Nacion Dentro Del Proceso De Constitucionalidad De La Referencia. A Juicio De La Petente, El Procurador Tiene Un Interes Directo, Fundado En Razones Morales, Para La Declaratoria De Inconstitucionalidad De Las Normas Revisadas En El Proceso En Cuestion. La Corte Destaco Que, De Los Argumentos Expuestos En La Demanda, Podria Derivarse Igualmente El Encuadramiento En La Causal “haber Conceptuado Sobre La Constitucionalidad De La Disposicion”. En Relacion Con La Primera Acusacion, Se Estimo Que Las Conductas Reveladas No Pueden Tenerse Como Tipificacion De Un Interes Moral, Pues Las Convicciones Religiosas No Le Impedirian Al Procurador Obrar Conforme A Los Imperativos Del Ordenamiento Juridico. Ademas, La Sala Considero Que De Los Textos Obrantes Como Pruebas En El Expediente No Podria Derivarse La Extraccion De Una Manifestacion Con El Alcance Que La Solicitante Le Asigna. Finalmente, Se Sostuvo Que Para Que Se Predique La Existencia De Un Pronunciamiento Previo Por Cuya Virtud Un Procurador O Magistrado Deba Declararse Impedido, Se Requiere Que Este Bo Solo Comporte La Expresion De Una Conviccion General, Sino Un Verdadero Concepto Sobre Determinada Materia. La Sala Estimo Que Ello No Acontecio En Relacion Con El Actual Procurador. Negada
