Se ordenó dejar sin efecto el auto mediante el cual el Juzgado de la referencia denegó la impugnación presentada por el actor, dentro de la acción de tutela instaurada por éste en favor de su hijo, menor de edad, en contra de CAJANAL E.P.S.
Lo anterior, porque para la Corte no quedó duda que el escrito de impugnación suscrito por el actor y en el que manifiesta su inconformidad con la decisión que denegó el amparo solicitado fue presentado dentro del término establecido para ello, razón por la que su derecho a que ésta se tramitara no podía ser denegado.
En consecuencia, se ordenó remitir el expediente de la referencia al Tribunal Superior del Atlántico, Sala Civil, para que se decida, en los términos legales.
