Recurso de súplica interpuesto contra el Auto del 28 de abril de 2010, dictado en el proceso de la referencia por el Magistrado Nilson Pinilla Pinilla, que rechazó la demanda por existir sentencia que ha hecho tránsito a cosa juzgada constitucional en relación a los cargos invocados por el actor.
La Sala concluye que el auto que rechazó la demanda debe ser confirmado en cuanto existe sentencia que ha hecho tránsito a cosa juzgada constitucional.
