Se declaró la nulidad del Auto proferido por la Sala de Casación Civil de la Corte Suprema de Justicia, sobre el expediente 7611122100002002-00094-01 y se le ordenó resolver la impugnación de la decisión tomada en primera instancia por el Tribunal Superior del Distrito Judicial de Buga dentro de la tutela propuesta por el ciudadano de la referencia contra la Sala Disciplinaria del Consejo Seccional de la Judicatura Valle, tal como lo prescribe el Art. 86 constitucional, en armonía con el Decreto 2591 de 1991 en su Art. 32: “Presentada debidamente la impugnación el juez remitirá el expediente dentro de los dos días siguientes al superior jerárquico correspondiente”.
En consecuencia, se remite el expediente a la mencionada Sala para lo de su competencia.

- PRIMERO. Declarar la nulidad del Auto de fecha 3 de febrero de 2003, expediente 7611122100002002-00094-01 proferido por la Sala de Casacion Civil de la Corte Suprema de Justicia.
- SEGUNDO. Ordenese a la Sala de Casacion Civil de la Corte Suprema de Justicia resolver la impugnacion de la decisicion tomada en primera instancia por el Tribunal Superior del Distrito Judicial de Buga dentro de la accion de tutela propuesta por el ciudadano Edgar Emiro Rueda Potes contra la Sala Disciplinaria del Consejo Seccional de la Judicatura Valle.
- TERCERO. Remitase el expediente contentivo de la accion de tutela a la Sala de Casacion Civil de la Corte Suprema de Justicia para dar cumplimiento al numeral
- segundo. de este Auto.
