Se remitió el expediente de tutela al Tribunal Superior de Antioquia, Sala Penal, para que asuma de manera inmediata el conocimiento de la presente acción de tutela, toda vez que según el Art. 2º del Decreto 1382, las tutelas interpuestas contra funcionarios judiciales deberán ser conocidas por el superior jerárquico del accionado, en este caso, el mencionado.
Esta competencia se ve fortalecida, puesto que, según el Art. 1º, numeral 1º, del decreto citado, el Tribunal también conoce de las acciones interpuestas contra entidades de carácter nacional como lo es la Registraduría Nacional del Estado Civil.
