Solicitud de nulidad de la Sentencia T-168/22, formulada por el Representante Legal del Colegio Nuestra Señora de las Nieves.

El peticionario alegó la evidente, notoria y flagrante vulneración del debido proceso y, por ende, el de defensa y acceso a la administración de justicia.

Así mismo adujo la trasgresión de los principios a la igualdad y a la imparcialidad y las garantías convencionales, constitucionales y legales.

La Sala Plena encontró que el solicitante, contrario a fundamentar una vulneración al debido proceso, pretendió reabrir un debate ya concluido y, con ello, incumplió con el requisito de la carga argumentativa, en los términos en que lo exige la jurisprudencia de la Corporación.

Con base en lo anterior se RECHAZA la nulidad invocada.

  1. PRIMERO. RECHAZAR, por no cumplir el requisito de carga argumentativa, la solicitud de nulidad formulada por el representante legal del Colegio Nuestra Señora de las Nieves, el señor José Alcides Sanabria Sedano, en contra la sentencia T-168 de 2022.
  2. SEGUNDO. COMUNÍQUESE la presente providencia a quien presentó la solicitud de nulidad y a las demás partes e intervinientes en el trámite, con la advertencia de que contra esta decisión no procede ningún recurso.
