Solicitud de cumplimiento de la Sentencia T-1028/10.

La memorialista solicitó a la Corporación que se tomen las medidas conducentes para hacer cumplir el fallo de la referencia, pese a haber iniciado el correspondiente incidente desacato y haber sido el mismo resuelto por el juez de primera instancia.

La Sala estima que el juez del caso adoptó las medidas necesarias para el cumplimiento de la sentencia en cuestión, tanto así que la pensión reconocida a la peticionaria fue reliquidada.

Se determina igualmente que, el supuesto incumplimiento no es manifiesto ya que el asunto controvertido gira en torno a la fórmula de la indexación y no al derecho a la indexación en sí mismo.

Se decide NO ASUMIR el conocimiento del trámite de cumplimiento de la sentencia T-1028/10
