Se declaró la nulidad de todo lo actuado en la acción de tutela promovida por los ciudadanos de la referencia en contra del Fondo Nacional de Prestaciones del Magisterio a partir del auto proferido por el Juzgado Segundo Penal del Circuito de Ocaña.
Lo anterior, porque el citado despacho judicial aplicó lo dispuesto en el Art. 1 del Decreto 1382 de 2000, norma que es manifiestamente contraria a la Carta Política.
En consecuencia, se remitió el expediente al mencionado Juzgado para que realice el trámite que corresponda conforme a la ley.
